The mission of the Community Television Facility is to provide city residents with training and equipment to produce video programming for the channel. Municipal meetings are also videotaped and cablecast to over 11,000 homes in South Portland and Cape Elizabeth. Community Television also accepts messages of community interest from non-profit organizations and municipal announcements, which are shown free of charge on Channel 2. Funding for community television is provided by the Franchise Fee, which is paid to the city by Time Warner Cable. The Franchise Fee is a right of way fee or a form of rent that cities and towns can charge the cable operator for the privilege of using its roads and to help support Community Television. Since 1990, cable companies have been allowed to show this fee on the subscribers cable bill, but the courts have ruled that it is not a tax and the cable company is not acting as a collection agent on behalf of the town. Many Maine towns put this fee in the General Fund and use it for other purposes unrelated to Community Television. South Portland allocates 60% of the fee it receives to Community Television and in this way, all South Portland cable subscribers are able to watch and participate in events that take place in their community through locally produced television programs with no impact on the property tax roles. South Portland Community Television is staffed by a manager and a Media Specialist who assist with training, editing and programming the video tape projects that are created by residents. Special attention is given to those projects that inform and educate the community about its history, culture and heritage. Current events are also highlighted in a series of programs about major construction projects in the city and live call-in talk shows are also featured. Community Television is also responsible for implementing the requirements of the Cable Television Franchise with Time Warner, which includes a city-wide interactive data network. Working with Time Warner and suppliers of computer related equipment, the Community Television personnel coordinate and implement the South Portland Technology Plan which includes the establishment of Local Area and Wide Area computer networks between municipal and school buildings. South Portland Community Television Rules and Procedures May 2002 Definitions: Access Producer refers to a resident of the City of South Portland, or a person designated by an eligible non-profit organization, that assumes responsibility to produce a video to air on SPC-TV, using SPC-TV equipment. Access Producer File refers to records on individual Access Producers established and maintained by SPC-TV staff. Access Sponsor: refers to a resident of the City of South Portland, or a person designated by an eligible non-profit organization, that assumes responsibility for the content of a program that they provide to SPC-TV. Sponsored programs shall provide a local phone number at the end of the program that residents may contact FMI. Airtime refers to any scheduled or unscheduled cablecast on SPC-TV to the Time Warner cable subscribers of the City of South Portland. Ancillary Assistant refers to anyone who assists an Access Producer in the production of a video to air on SPC-TV PEG but does not use or handle SPC-TV equipment. Certified describes an eligible person who has completed training and orientation requirements as an Access Producer. Educational Access Programming refers to programming that is produced by or sponsored by the South Portland School Department. These programs are shown on Channel 3, the South Portland Educational Access Channel (S.P.E.A.C), unless requested to be shown on SPC-TV Channel 2. Programs shown on S.P.E.A.C. are regulated by the South Portland School Board. Electronic Bulletin Board refers to computer images that scroll on SPC-TV between SPC-TV programs. Eligible Nonprofit Organization refers to any entity organized under state law as a nonprofit organization and which either is located in the City of South Portland or provides all or some of its services within the City of South Portland. Eligibility refers to the right to apply, pay for, or access services or facilities at the South Portland Community Television Access Center. Good Standing means not currently under SPC-TV suspension. Government Access Programming refers to programs that are produced by or sponsored by the City of South Portland. Such programs are regulated by Municipal officials and the staff of SPC-TV. Instant Access refers to arrangements made by SPC-TV staff to provide eligible residents and nonprofit organizations with recorded or live airtime without certification requirements. Normal Operating Hours refers to scheduled times when the SPC-TV facility is available for use. Normal Operating Hours will be posted at the facility. PEG refers to Public, Educational and Government Channels Public Access Programming is programming of community interest that may be produced by, or sponsored by, a South Portland resident or non-profit organization. There are some restrictions as to the time slots designated for Public Access Programming depending on Municipal programming requirements, the nature of the program, and compliance with the terms set forth in Section G of this Policy. SPC-TV Equipment refers to any production equipment owned, leased or managed by SPC-TV for the production of videos; this may include but is not limited to: audio equipment and cables, video equipment and cables, lights, stands, cablecasting equipment, character generators, set pieces and computers. SPC-TV Staff refers to anyone designated by South Portland Community Television to manage and/or operate SPC-TV. SPC-TV Suspension means loss of all services and privileges associated with SPC-TV including use of production facilities, airtime and the electronic bulletin board. SPC-TV Volunteer refers to anyone who is authorized by SPC-TV staff to perform staff-designated tasks in the operation of SPC-TV, said tasks on a voluntary, non-paid basis. South Portland Community Television (SPC-TV) refers to the television station, its staff and facilities, located at 25 Cottage Road and the signal it cablecasts to Time Warner Cable subscribers. Production Assistant refers to anyone who uses SPC-TV equipment to assist an Access Producer in the production of a video to air on SPC-TV PEG Channels. Production Facilities refers to any equipment, spaces or materials owned, leased or managed by SPC-TV. Release refers to any documentation stating that a producer has the right to use the video or audio image of a person or copyrighted material. Talent refers to anyone who appears in, or is heard in a video production. Underwriting refers to the practice of funding the costs associated with producing a program a by one or more commercial or non-commercial entities. Recognition may be given to the underwriter at the beginning and end of the program using the PBS model, i.e. this program was made possible by a grant from _________. Such recognition may contain a single graphic logo representation of each underwriter, and may not be more than 30 seconds in total length. Section I - Rules of Operation: A. Eligibility & Certification Requirements for use of production facilities: 1. Production Facilities can only be used by certified Access Producers, and Production Assistants (except as provided below for the Instant Access Program) who are 18 years of age or older. Those under 18 must have the supervision of a certified adult, and have written permission from their parent or legal guardian. 2. An Access Producer must show proof of residence in the City of South Portland or affiliation with an eligible nonprofit organization. Proof of residency must consist of a valid drivers License or photo ID and a utility bill or rental lease with their name and address. The utility bill or rental lease must have an invoice date within the previous two months. Copies of proof of residency must be kept in the Access Producers file. SPC-TV may request proof of residency at any time. 3. Affiliation with a nonprofit organization serving the City of South Portland must consist of a valid drivers license or photo ID and a letter from the nonprofit organization stating the identified person has the authority to either produce a video on behalf of the nonprofit, or to request the cablecast of a program representing the nonprofit. This eligibility is limited to the production or replay of a video for that nonprofit organization, for airing on SPC-TV. The letter from the nonprofit organization must be on the organizations letterhead and must bear a valid City of South Portland address or include proof that it provides services within the City limits of South Portland. 4. All Production Assistants must be designated in writing by an Access Producer and such documentation must be kept in the Access Producer file. Production Assistants may only use facilities under the direction of a certified Access Producer for the purpose of making a video production for that Access Producer to be shown on SPC-TV. 5. Access Producers and Production Assistants must be certified. Certification includes successful completion of an SPC-TV field course, edit course, studio course and SPC-TV orientation. Only the SPC-TV field course may be waived after demonstrating proficiency to SPC-TV staff. Records of successful completion must be maintained in the Access Producer file for both the Access Producer and Production Assistants. These courses are free of charge to South Portland Residents and Eligible Non-Profits and may be scheduled on an individual basis or as a group. 6. Talent and Ancillary Assistants must be verbally and visually identified by an Access Producer to SPC-TV staff upon staff request. Producer must provide a crew and guest log for each production in the studio to SPC-TV staff. 7. Access Producers must complete all necessary forms for the use of SPC-TV facilities and airtime. See attached forms. 8. Access Producers, Production Assistants, Ancillary Assistants and Talent must be in good standing with the SPC-TV, in order to use the facilities. 9. Eligibility for the use of air time is the same as for Access Producers, except certification is not required. Anyone requesting air time must complete all necessary forms, sign releases, and demonstrate permission to use any copyrighted material. Also, video and audio material must meet industry standards for technical quality. 10. Eligibility for the use of the electronic bulletin board is limited to nonprofit activities, or activities or information that is clearly of use or benefit to residents of the City of South Portland, or requested by a resident of South Portland. B. Producer Responsibilities: 1. Certified access producers must comply with the following responsibilities: SPC-TV requires the completion of the following forms for designated activities. All completed forms must be kept in Access Producer file. 2. Access Registration forms must be completed by the City of South Portland residents or representatives of eligible nonprofit organizations at the time they register for courses, and whenever any information on the originally completed form becomes outdated. This information will include name, address, phone numbers, e-mail address (if applicable), courses completed and other information as deemed necessary by SPC-TV staff. All Producers using SPC-TV equipment and facilities must provide identification in the form of a current utility bill or rental lease, and also a drivers license or Photo ID in order to verify residency, every six months. 3. Sponsor Application forms must be completed by the City of South Portland residents who wish to request cablecasting services for their programs. The sponsors name and a local phone number shall be added to the end of the program as a 15 second tag to identify themselves to the community. 3. User Application and Certificate of Compliance forms must be completed by anyone wishing to produce any video/audio live or taped program for cablecast on SPC-TV . In addition, the information provided shall specify if the content is of a mature (adult) nature. This form must be completed once a month for each program for which air time is requested. It must be submitted by the 15th of the month prior to the month of broadcast. 4. An Equipment Loan Form must be completed when SPC-TV staff and Access Producer are checking out and checking in equipment. This form must verify the condition of all equipment being loaned before and after loan and bear the signature of both the producer and SPC-TV staff. Producer is responsible for missing or damaged equipment. (Only staff can reserve equipment and check-in/out equipment for use by Producers.) 5. Room Use: Producers are responsible for reserving the Studio/Council Chamber at least one week in advance with the city clerk who maintains a room use log. SPC-TV staff and the Access Producer shall review the condition of the Studio/Council Chamber and Control Room before and after use. The Producer is responsible for missing or damaged equipment, or furnishings, including soiling of furnishings, carpet or equipment. Other Responsibilities: 1. Except in cases where producers are borrowing equipment for the first time to experiment and learn how to use it, the sole use of equipment must be for the purpose of making a video that will appear on SPC-TV Channels. Producers must submit a video for airing on SPC-TV Channels within six months of first using access facilities. With each tape submission, SPC-TV staff reserves the right to determine, without regard to content or quality of the work, if the video production submitted warranted the amount of time the producer used access facilities. If SPC-TV staff determines that the amount of time is inordinate, the SPC-TV staff may find the producer in violation of this rule. (Refer to section M). 2. Each certified producer must complete 6 hours per year of volunteer time with an assigned SPC-TV staff. 3. Upon determination of SPC-TV staff, certified producers may be required to take refresher courses in equipment and/or orientation. 4. Certification on any new equipment must be preceded by the previous courses, including field (camcorder) and analog editing instruction. The purpose of this is to give priority use of new equipment to long-standing, skilled Access Producers. New equipment is subject to the same rules as existing equipment, including training, demonstration of competency, use, responsibility for, and care. 5. Approvals and responsibilities for productions are given to designated producers. Any change in a production producer will require the new producer to seek all approvals and fulfill all responsibilities required above. 6. Production Facilities may only be used by certified Access Producers and Designated Production Assistants in order to produce a video program to air on SPC-TV Channels. D. Reservation Policy 1. Production Facilities can be used/borrowed at any time without reservations if the requested facility/equipment has not been reserved, is not already being used, and if an SPC-TV Staff person is available to supervise. 2. Production Facilities can be reserved up to two months in advance. 3. Field equipment and editing suites cannot be reserved for the same time and day of the week for more than two consecutive weeks. 4. Field equipment cannot be reserved for more than two consecutive days that SPC-TV has normal operating hours except by special permission, based on availability. Field equipment cannot be reserved for more than 6 days of normal operating hours per month. Reservation of more than one camera or set of equipment is discouraged, however, permission may be granted on a per case basis, based on availability. Two cameras would then count towards the 6-day usage rule. 5. Edit suites cannot be reserved by any one entity for more than 12 hours in one week. 6. Studio facilities cannot be reserved by any one entity for more than 6 hours in one week. E. Cancellation Policy 1. If a producer wishes to cancel a reservation, the producer must do so at least 12 hours in advance of reservation. Cancellations of less than 12 hours in advance of reservation time will only be allowed if the producer requests a waiting list from SPC-TV staff and agrees to call all the people on the waiting list until a person is found who can use the same equipment/facility at the same time as was previously requested. F. Care and Use of Facilities 1. All SPC-TV facilities must be handled as instructed during training and during productions with reasonable care and safety. 2. The Access Producer is responsible for all damages, loss, or cost of repair involved while the equipment is in the producers possession. This will be determined by the use of the Equipment Loan forms. Access Producers privileges will be suspended until any money owed to SPC-TV for repairs or replacement is paid. 3. Access Producers must not change settings or rewire SPC-TV facilities other than as instructed during training. 4. Access Producers must not threaten or otherwise imply any intent to damage SPC-TV facilities. If SPC-TV staff have reason to believe, SPC-TV facilities are at risk of damage by a producer, SPC-TV staff reserves the right to suspend SPC-TV privileges indefinitely without following Corrective Action Procedures. 5. Theft of SPC-TV property will be grounds for immediate and indefinite suspension of privileges. This rule is, therefore, not subject to corrective action procedures described in section M below. 6. Anyone suspected of being under the influence of alcohol or illegal drugs will not be loaned equipment and may be asked to leave SPC-TV premises immediately. 7. Anyone using SPC-TV facilities must abide by all local, State and federal laws. Anyone using SPC-TV facilities must not verbally abuse, harass, insult or threaten any other person. 8. Anyone using SPC-TV facilities must not disturb or interfere with others using the facility. Anyone entering the building must respect the use of city property and the right of SPC-TV staff to safeguard and maintain common areas. G. Content Guidelines 1. Air time is a privilege granted to the residents of the City of South Portland and eligible nonprofit organizations when requested and all programming shall comply with the following guidelines: a. Commercial or obscene material is not permitted. b. Fundraising for nonprofit organizations is permissible. c. Fundraising for political candidates or causes is not permissible. d. Announcements of political activities and political points of view are permissible. Reference candidates letter attached. e. Copyright protected material is only permissible if the Access Producer can provide documented proof that the Access Producer has permission to use the copyright protected material at least a week in advance of use. Such documentation must include: -Specific identification of the material to be used (complete or in part (length), audio, video or both, etc.). - Name of program for which permission is given. - The duration of time permission is given. - If music, permission must include synchronization rights as well as releases from all composers, performers and producers involved. f. Implicit or explicit threats of violence against any person or group of people are forbidden and may be subject to prosecution if in violation of law. g. Insulting or offensive language or comments that may be found to be libelous, or slanderous about any person or group of people is discouraged and may be subject to prosecution if in violation of the law. Reference attached User Application, Compliance & Certification Form in Section: B3 2. SPC-TV staff reserves the right to schedule programs as they determine appropriate. 3. Programs with mature (adult) content including but not limited to descriptive sexual behavior will be aired between 11PM and 5AM Sunday through Thursday and between 12AM and 5AM Friday and Saturday only. This does not restrict the responsibility of SPC-TV staff to schedule programs at whatever times they determine appropriate. Any live program aired in violation of this rule will subject the Producer to disciplinary action. H. Series Programming 1. Regular series may not run for more than one year. After the first year, the series may continue if no other producer requests the same time period. Unless otherwise restricted by these rules and procedures, air time is allocated on a first come, first serve basis. I. Access after hours 1. From time to time, SPC-TV may provide alternative access to eligible City of South Portland residents and nonprofit organizations. When access producer usage does not warrant changing existing scheduled access hours, certified access producers may purchase additional hours for the use of facilities at a rate of $40.00 an hour, which is our cost for providing staff and overhead, if staff is available. When producer usage of the facility warrants a change in the SPC-TV operating schedule for free access that includes time being purchased, free access will take priority. All other rules herein apply to this purchase of air time. J. Instant Access 1. SPC-TV may establish during regular operating hours up to 3 hours for Instant Access. In the event that the Producer is unable to obtain production personnel, SPC-TV staff will handle all equipment required for a very basic soapbox production at a rate of $1.00 a minute. Any City of South Portland resident or nonprofit organization using instant access must sign all required releases. K. Announcements and messages must be less than 30 words and must not contain the following: - Lottery, or information about a lottery, gift enterprises or similar schemes. - Any solicitation of funds or advertising designed to promote the sale of commercial products or services. - Any material that violates Town, State, or Federal laws including, but not limited to those relating to sedition, defamation, slander, libel, invasion of privacy, trademark or copyright. - Announcements of a political nature that urge viewers to support a particular point of view except if they are provided by a legitimate non-profit entity, currently elected official, or political candidate for office and are accompanied by a signed request . In addition, the sponsors name or organization must appear on the announcement. - Obscenity as defined by community standards. 3. Announcements must include the following information: - Name of the organization that is submitting the message. - Name and phone number of a contact person that can be shown with the message FMI. - Time, Place and Date of the event along with any fee that may be charged. 4. South Portland Public Access will make every effort to post messages in a timely manner, however we make no guarantees. We will attempt to present messages as clearly as possible, with an emphasis on readability and visual interest. Specific backgrounds or colors may be requested, however the final look shall be at the discretion of the person entering the message. 5. Persons submitting messages are encouraged to create their own PowerPoint( slide to insure that the announcement is presented in a manner consistent with their objectives. Up to 10 slides per subject or event will be accepted for placement on the bulletin board and shall be played in normal rotation along with other announcements of a similar nature. 6. Message duration shall be of sufficient time to read in a normal manner, such time to be determined by the person entering the message. 7. Interpretation of these rules shall be at the discretion of the Public Access Director, however an appeal of said decision may be made to the CATV Regulatory Board, whose decision shall be final. We cablecast 24 hours a day to over 11,000 homes in South Portland and Cape Elizabeth. You may be interested in using this resource as a means of informing the public about your candidacy or about issues that will be voted upon in the upcoming elections. Your access to Channel 2 is a free service furthering our mission, which includes informing the residents of South Portland about the political processes and issues in all elections. We would like to extend the option of showing up to ten of your PowerPoint( slides on the SPC-TV Bulletin Board. Your message may include any information you wish except for direct solicitation of contributions to your campaign unless your campaign organization is listed as a 501c3 non-profit.. You may update this message weekly in accordance with the Guidelines for Submitting Announcements, (see attached). Messages will be shown in rotation with our other announcements continuously until day of the election. SPC-TV is also offering the use of our Public Access television equipment to any South Portland resident candidate who wishes to make a public service announcement about their campaign. This equipment is being offered along with training for you or your staff on a first come, first served basis. For non-residents, check with the community television facility in your city or town. Additionally, SPC-TV will accept video tapes that you provide for cablecasting until the day of elections. These tapes will be shown on an equal-time schedule, and as often as the program schedule will allow. We reserve the right, however, to schedule these tapes at the staffs discretion to avoid conflicts with previously scheduled municipal meetings. Please refer to attached compliance form. Video tapes must be VHS format, recorded in SP speed, starting at the beginning of the tape. Please provide approximately 15 seconds of black (fade in from black or leave the lens cap on) at the beginning of the tape. General Rules 1. Use of mailing address, phone, fax, e-mail, internet, office supplies, computers, copy machines and other office equipment is restricted to SPC-TV staff and volunteers. From time to time, SPC-TV staff may give permission to use the above upon request on a case-by-case basis. Producers may use the 767-7615 number for call-in shows during that broadcast. If Producers require audience feedback, they may provide their own telephone number, address or e-mail. SPC-TV telephone numbers and facility address are not to be used for producer and viewer correspondence. Viewers wishing to address specific station concerns may write to SPC-TV at: Viewer Comment, South Portland Community Television, 25 Cottage Road, South Portland, Maine 04106. 2. SPC-TV must authorize use of props and furniture, and such use is limited to some of the items located in the storage facility. Producers are not to remove office furniture or other items from the SPC-TV offices for use on the set. The same care for these items, as equipment, is expected and required. All items are to be returned to original position after production. Producers are responsible for loss or damage to these items as well. Producers are encouraged to use their own props, however, storage of those items is prohibited at SPC-TV due to limited space and liability issues. 3. The use of the common areas in City Hall is granted by special permission, and is generally not available for non-production oriented activities. Please see staff for permission and scheduling of any events in these areas. 4. Producers are not to have personal mail, packages, faxes or calls directed to SPC-TV. Also, we are not responsible for materials left here, including tapes, disks or computer data. A lost and found is located in the lobby; left items will be located there for a limited time. 5. Eating and drinking in studio and control room is strictly prohibited. Water, without ice (due to sweating) in pitchers and glasses on the studio set for talent is permissible. 6. All videotapes for Access Producers productions must be supplied by the Access Producer or purchased from SPC-TV staff at the time of use. SVHS or VHS tapes may be supplied free of charge one (1) per production, when available, to Access Producers only. 7. Access Producers wishing to collect underwriting funding and/or give underwriting credit must first have written authorization from SPC-TV and must follow Underwriting Guidelines (available upon request). 8. All programs must meet the following technical standards: All programs must be VHS videocassettes, or DVD-R Format, capable of being timebase corrected and meeting other standards listed below. Programs must have a continuous control track and should be recorded at Standard Play (SP) speed (tape only). Program audio should be recorded on audio channel 2 (normal mono track) and not exceed OdB. Programs must be no more than the third generation of the master video footage with low noise and a minimum of color smearing. Maximum reference levels are 40 IRE unites of sync, 7.5 IRE units of black level and no more than 100 IRE units of video. All programs should lead in with black for a minimum of 15 seconds before program starts. g. All videotapes must be properly labeled on both the cassette and the cassettes carrying-case with standard labels. The labels will contain the following information: program title, producer, and date of completion and exact program length and pre-roll time. DVDs must be marked in a similar fashion. M. Corrective action procedures 1. The following procedures apply to all the above rules, unless otherwise specified. The Access Producer is responsible for knowing, understanding and following all the rules and procedures listed above. Therefore, the violation of any rule will be grounds for following the first corrective action. In general, these actions will be taken in a progressive fashion, with a written reminder for the first violation, written warning for the second, etc. However, in some cases, the rule violation maybe so serious as to warrant immediate suspension of privileges, such as an assault on another person, disruption of other peoples productions, violation of law, etc. SPC-TV reserves the right to impose corrective action appropriate to the violation in all cases. The first violation of any SPC-TV rules and procedures will result in a written reminder. The second violation of any SPC-TV rules and procedures will result in a written warning. The third violation of any SPC-TV rules and procedures will result in a $10 fine with suspended privileges until the fine is paid. The fourth violation of any SPC-TV rules and procedures will result in a two-month suspension of privileges. The fifth violation of any SPC-TV rules and procedures will result in a suspension of privileges for no less than one year, and up to a lifetime suspension. Prior to finding a violation, SPC-TV Staff will meet with the Access Producer or Producers, as well as any other staff involved in the issue, and notify the Producer(s) of the basis for the violation. The Access Producer or Producers will have an opportunity to respond to the charge. This meeting will be informal and is not an adversarial hearing. N. Grievance and Appeal 1. If an individual disagrees with the action of SPC-TV staff, the individual must first address the grievance with the SPC-TV staff in question. 2. If the individual does not receive satisfaction from the SPC-TV staff within seven working days, the individual must submit the grievance in writing to the Access Manager. 3. In the event the Access Producers or Producers disagree with any corrective action taken by the Access Manager, they may appeal it to the SPC-TV Regulatory Board within 15 calendar days of the action. The Board Chairman or his/her designee will hold an informal hearing with the Access Manager, appropriate staff and the Access Producer or Producers and with any witnesses, and issue a written decision within 10 days of the hearing. The decision of the Board of Director Chairman or his/her designee will be final and not subject to further appeal. Policy Notice: Any portion of this policy may be waived by the Access Director due to extenuating circumstances such as illness or Acts of God.
